Damage report

Would you like to report a claim? Please send the following documents for submission to the insurer – please send them by e-mail to info@yacht-pool.at

  • Your current contact details
  • Copy of the driver’s license
  • Detailed damage report on the course of the accident with the following contents: – Who was the responsible skipper? – Who was the helmsman? – Where did the ship come from and where was it going? – Exact indication of the nautical position at the time the damage occurred on a detailed chart – Course and speed before the damage occurred – How was navigation carried out? – Was there a nautical chart (paper) on board (age and scale)? – Did you navigate using GPS only? – In case of grounding: Was the echo sounder observed immediately before/during the grounding? – If so, what was the indicated water depth? – Is the shoal recorded? – Why was the boat driven at the point of grounding (in shallow water)? – Was the damage noticed while driving? If so, what was the response? – Light and weather conditions at the time of damage – time of day – visibility – swell – wind force and weather conditions

  • Names, and addresses of the parties involved
  • Names, addresses of witnesses, and their reports
  • Protocols of official bodies (e.g. harbor master, water police)
  • Address, file number of the police station recording the incident

Important general information:

Please report any liability and deposit damage to the charter company immediately. IMPORTANT: All liability claims must be reported to the port captain!
  • Please report the damage in writing by e-mail or telephone to YACHT-POOL.
  • Theft must always be reported to the police.
  • Please ensure that the damage caused is reduced and further damage is prevented.
Please send the following documents to the insurer for submission – we ask you to send them by e-mail to skipper@yacht-pool.de
  • Copy of the charter contract
  • Copy of the crew list
  • Detailed description of the damage – (description of the incident, date, place, signature of the co-skipper or a crew member)
  • Additional documents depending on the type of damage as follows:

In the event of a liability claim (collision damage), please submit the following documents:

Note: Please note that this is a liability claim that must be settled in full by the transport liability insurer of your charter company, which has taken out liability insurance for the charter yacht. Therefore, please report the damage immediately to your charter company with the corresponding request to forward it to the ship’s liability insurer and – if and insofar as available – provide the personal details of the injured party.
 
Please note that your charter company may not retain the deposit due to damage to the other party’s yacht.
 
With regard to the YACHT-POOL skipper’s liability insurance, there is in principle an obligation to perform, but with regard to the ship’s liability insurance only subordinate to section 4.1 of the conditions, which the owner must regulate here.
 
Documents:
  • Accident report (with sketch: Sail direction, wind direction, engine on/off, courses of both yachts, witnesses, etc.).
  • Damage images – please use low resolution!
  • Copy of the driver’s license
  • official notification to the port authority – lučki kapetan required!
  • Insurance confirmation of your yacht (located in the navigation table) and the injured party
  • Confirmation of the damage report to the charterer at the base management on site

In the event of damage to your own charter vessel (deposit), please submit the following documents:

  • Damage photos in low resolution please!
  • Detailed repair invoice (labor and material costs as well as VAT must be shown)
  • Proof of the retained down payment amount
  • Bank details to which the payment is to be made

For charter cancellation insurance, please submit the following documents:

Failure of the skipper (total failure of the trip):
  • The enclosed “medical certificate” from YACHT-POOL with the stamp and signature of the attending physician must be returned to us.
  • For co-insured flights, the official flight cancellation certificate from the airline
  • For co-insured flights, official proof of the total flight costs of all crew members
  • Bank details to which the payment is to be made (if different from the call-off account)
  • After the end of the planned charter: Please request a cancellation invoice from the charter company, which takes into account a possible new charter of the ship.
Loss of a crew member:
  • Please return the enclosed “medical certificate” from YACHT-POOL with the stamp and signature of the attending physician to us
  • For co-insured flights, the official flight cancellation certificate from the airline
  • For co-insured flights, please provide official proof of the total flight costs of all crew members
  • Short confirmation from you as skipper that no substitute has taken part
  • Bank details to which the payment is to be made

Attention: If this is not observed, there is a risk that the insurer will no longer be liable to pay benefits!
